Polish court rules against rocker who tore up Bible on stage

Poland's Supreme Court opened the way on Monday for a blasphemy verdict against a rock musician who tore up a Bible on stage, a case that has pitted deep Catholic traditions against a new desire for free expression.

Adam Darski, front man with a heavy metal group named Behemoth, ripped up a copy of the Christian holy book during a concert in 2007, called it deceitful and described the Roman Catholic church as "a criminal sect".

His supporters say it was an act of artistic expression, but conservatives say he offended the sensibilities of Catholics in Poland, the homeland of the late Pope John Paul II and one of the religion's most devout heartlands in Europe.

The Supreme Court was asked to rule on legal arguments thrown up by the musician's trial in a lower court on charges of offending religious feelings.

It said a crime was committed even if the accused, who uses the stage name Nergal, did not act with the "direct intention" of offending those feelings, a court spokeswoman said.

That interpretation closed off an argument used by lawyers for Darski, who said he had not committed a crime because he did not intend to offend anyone.

The lower court will now decide if he is guilty. The maximum sentence is two years in jail, under Poland's criminal code. However, it is extremely rare for anyone convicted of this kind of crime in Poland to serve prison time.

"(The decision) is negative and restricts the freedom of speech. The court decided that this is allowed in a democratic system," Jacek Potulski, a lawyer for Darski, told Reuters.

He said he was not giving up. "We are still arguing that we were dealing with art, which allows more critical and radical statements," the lawyer said.

Ryszard Nowak, a conservative former member of parliament who has for years been lobbying for the musician's conviction, said he had been vindicated.

"The Supreme Court said clearly that there are limits for artists which cannot be crossed," Nowak told Polish television.

The Catholic church and its teachings have been at the heart of Polish life for generations, but changes in society are challenging the dominance of the faith.

Opinion polls show that while 93 percent of Poles identify themselves as Catholics, the proportion who attend church or pray regularly is in decline, especially among young people.

Large parts of Polish society have also started to drift away from some of the church's teachings, especially its ban on contraception and its opposition to homosexual partnerships.

"When it comes to bishops' opinions on controversial social issues, I listen to them, but I don't treat them as an absolute authority," said Aleksandra Pulchny, a 22-year-old law student from Rybnik, in southern Poland.

In one indication of the changes in society, the blasphemy trial does not appear to have harmed Darski's show business standing. He is one of four judges on "The Voice of Poland," a talent show broadcast on national public television.

Earnings Preview: Berkshire Hathaway 3Q earnings

OMAHA, Neb. (AP) ? When Berkshire Hathaway Inc. releases third-quarter earnings Friday, they will be dissected by investors looking for clues about the economy's health, what CEO Warren Buffett might invest in next, as well as any estimate of Berkshire's insurance losses from Hurricane Sandy.

Investors will also be interested to see how Berkshire's BNSF Railway fared as major freight railroads grapple with weak coal demand.

But the bottom-line profit the company reports could differ significantly from the operating results for Berkshire's 80-odd businesses because the paper value of its derivatives tied to several stock-market indexes varies widely.

WHAT TO WATCH FOR: Berkshire owns several large insurance and reinsurance companies, including Geico and General Re, so it often pays out sizeable claims after any major disaster.

For instance, Berkshire recorded a $2.4 billion loss from the Sept. 11, 2001 terrorist attacks. Insurance losses from Hurricane Sandy aren't likely to be a big concern for Berkshire, which has about $40 billion cash on hand, but they will affect fourth-quarter profit.

Jeff Matthews, an investor who wrote "Secrets in Plain Sight: Business & Investing Secrets of Warren Buffett," said it will be interesting to see how BNSF fared after other railroads reported lower coal volume and increases in crude oil and automotive shipments.

Matthews expects derivative contracts to be somewhat positive for Berkshire in the quarter. Last year Berkshire recorded a $1.53 billion paper loss on its derivative contracts and investments in the third quarter.

Several Berkshire subsidiaries are tied closely to residential housing ? including Shaw carpet, Acme Brick, Clayton Homes and HomeServices of America real estate ? so the quarterly report will offer some insight into the U.S. housing industry's recovery.

WHY IT MATTERS: Buffett's remarkable investing track record has earned the company a devoted following. Berkshire is also watched closely because the conglomerate's results offer a glimpse into a variety of industries.

WHAT'S EXPECTED: Analysts surveyed by FactSet expect Berkshire to report earnings of $1.38 per Class B share on $39.04 billion in revenue.

LAST YEAR'S QUARTER: Berkshire's net income fell 24 percent last year to $2.28 billion, or 92 cents per share, because of a sharp decline in the paper value of its derivative contracts.

If I could import just one thing from Italy, it wouldn?t be a Dolce & Gabbana wardrobe or an Alfa Romeo sportscar or even a whole leg of Parma ham. In fact, I wouldn?t pick an object at all. Rather, I?d bring over the institution of aperitivo.

In Italy, the term ?aperitivo? ? ap?ritif in French, cocktail in English ? signals much more than ?happy hour.? While Italian liquors and previously obscure amari are starting to receive a lot of attention in the craft-cocktail renaissance, their context remains a bit of a mystery here. As wonderful as a bracing shot of Fernet Branca or a well-made Americano taste on their own, simply bellying up to the bar elides half of the picture ? the food half.

Aperitivo is the wonderful marriage of the two, the effusive cocktail party that happens every day at bars across Italy during those relaxed, possibility-filled hours between work and dinner. Rather than offering discounted drinks, Italian bars raise their prices between 6 and 9 p.m., sometimes quite a lot. The purchase of a ?10 Negroni, however, entitles you to pick up a flimsy plastic plate and head over to the buffet as many times as you like, sampling the bar?s selection of appetizers, generally known as stuzzichini (?toothpicks?) but, in Venice, as cicheti.

Bruschetta is an easy thing to serve for aperitivo.

The edible display can be stunning. Tiny squares of pizza, bruschetta, cooked greens, salumi, vegetable salads, marinated white beans, pasta, grissini, cheeses, polpette, grilled meats on skewers ? the variety and breadth of some bars? aperitivo offerings is truly incredible.

So is the scene. Businessmen in improbably impeccable suits shoulder in next to dreadlocked bikers, still improbably impeccable (this is Italy, after all), to grab one more scoop of that agrodolce cabbage with anchovies or snag a few more bruschette. Tiny women in achingly high stilettos tuck in to plates buckling under the weight of all that linguini. Ice-cold Moretti flows freely.

The aperitivo ritual, I think, perfectly illuminates the difference between American and Italian attitudes toward eating and drinking. In Italy, food and alcohol are so firmly linked that ordering an alcoholic drink at any time of day elicits at the very least a small bowl of supplemental peanuts, if not a platter of focaccia and prosciutto. Drinking without at least a small snack is practically unheard of, unless you?re having a digestivo after you?ve already eaten.

At aperitivo, the emphasis is placed even more strongly on food; it?s difficult, and expensive, to overdrink. Rather than leaving happy hour with a lightheaded buzz and an empty stomach, Italians are much more likely to leave wondering if they?ll have any appetite for dinner.

The American attitude toward happy hour ? as a time to knock back a few as quickly as possible, before that looming 6 p.m. cutoff ? contrasts starkly with the more relaxed Italian approach. While cultural norms regarding alcohol are changing, especially among young people, ?going out? just to drink is quite unusual in Italy, and public drunkenness is both uncommon and firmly frowned upon.

This is not to say that there isn?t a robust drinking culture. After all, Italy is practically synonymous with wine, and produces a vast range of spirits as well. The bitter flavors of many Italian liquors are considered to be appetite enhancers and digestive aids. Low-alcohol cocktails, such as Campari and soda or Aperol with Prosecco, are very popular at aperitivo, both because they enhance the food they?re consumed with and because they?re not strong enough to dull the senses and distract from the main event: eating.

You can easily imitate the Italian aperitivo experience at home. Aperitivo is all about simplicity and ease, and it?s a terrific model for a party, especially a summer one: refreshing, low-proof drinks and uncomplicated snacks. Here are a few tips to keep in mind.

Keep it simple

When I have people over to dine, my immediate impulse is to embark on an elaborate three-day cooking spree that dirties every dish in the house and requires an Excel spreadsheet to manage the shopping list. This is not what aperitivo is about. Aperitivo is for socializing, looking fabulous, and enjoying the late afternoon.

This applies equally to the drinks and the food. Campari and soda, a glass of chilled vermouth, even a well-made Negroni ? these are not fussy drinks. All it takes to make a classic Negroni, after all, is one part Campari, one part gin, and one part sweet vermouth gently stirred in a glass full of ice and topped with a twist or wedge of orange.

If you feel like turning on your range, keep it simple: toast some bruschetta in the oven and slather a variety of savories on top, or make a simple pasta dish on the stovetop, such as gemelli with pesto or rigatoni with raw chopped tomato. Throw in a veggie or two, maybe some cheese, and you?re set. Even just a plate of sliced and salted tomatoes with basil, braised chicory, or gratin?ed onions with breadcrumbs can make aperitivo special without making it exhausting.

Strive for variety

Many aperitivi offer a stunning array of choices, some with four separate buffet banquets themed around different ingredients. For those of us without staff and professional kitchens, this is out of reach. Variety at home might mean pizza made with three different toppings, or a charcuterie board with two different kinds of salumi and two different kinds of cheese. Even a small variety of tastes, textures, and types of food will go a long way: if nothing else, get the five different kinds of bulk olives you?ve been eyeballing at the grocery store and a jar of artichoke hearts.

Make it easy for everyone

One of the best parts about aperitivo is that it?s a serve-yourself affair. Throw some ice in a bucket for the drinks, have a stack of small plates and napkins next to the food, and let guests serve themselves. Disposable plastic plates are traditional at the bar, but plastic makes me feel guilty, so I use small, expendable ceramic plates from Goodwill that I won?t miss if they hit the patio.

Invite a crowd

Aperitivo is for everyone, from the very old to the highchair set. In Italy, whole extended families go to aperitivo together. It?s an inexpensive meal out, plus the variety means that everybody can find something they like to eat.

While the food is a big focus at aperitivo, socializing is just as important. It?s easy to forget in the face of all that culinary abundance, but Italy has a history of political upheaval, war, poverty, natural disaster, famine, and oppression that stretches back thousands of years. Food hasn?t always been something taken for granted on the peninsula, and social connections have been (and frankly still are) the most reliable source of support in most Italians? lives. These ties need to be nurtured. Plus, gathering al tavolo with the people you care about is what makes life worth living, plain and simple.

Take it outside

When the weather permits, Italian restaurants spill out onto sidewalks, piazzas, and alleyways ? sometimes even expanding all the way across streets, making it hard to tell which table belongs to which restaurant. Nobody wants to eat inside if they can help it. Buon appetito!

Medieval skeleton may be church founder

A skeleton found in the same boneyard where English King Richard III may have been buried might be one of the founders of the Church of the Grey Friars, archaeologists announced Tuesday.

Scientists have yet to examine the female skeleton, though they are subjecting a male skeleton suspected to be Richard III's to rigorous testing. Nevertheless, the researchers said it was no surprise to find a woman buried at the medieval church in Leicester, England.

"We know of at least one woman connected with the friary, Ellen Luenor, a possible benefactor and founder with her husband, Gilbert," said Mathew Morris, the site director of the University of Leicester Archaeological Services.

Mystery lady
Unfortunately, the definitive identity of the skeleton will likely remain a mystery, Morris said in a statement. The friary would have cared for the destitute and homeless, he said, so the woman could be a pauper as well.

"(W)ithout knowing where Ellen Luenor had been originally buried, we are unlikely to ever know who the remains are of, or why she was buried there," Morris said.

The female bones had been dug up and reburied at some point in the past, said Richard Buckley, the lead archaeologist on the project to find Richard III's bones. The medieval church site was later transformed into the garden of a mansion house during the 1600s, which may have been when the bones were disturbed, Buckley said in a statement. A lost king
The female skeleton is merely a sidelight in the project, which aims to find the bones of the lost King Richard III. The monarch ruled England from 1483 and 1485, before dying in battle during an English civil war. Historical records show that Richard III's remains were taken to Leicester and interred in the Church of the Grey Friars. However, the grave ? and the church ? were eventually lost.

Plenty of unsubstantiated rumors about Richard's body popped up in later centuries, including one myth that his bones were dug up and thrown in a river, and another claim that his coffin was used as a horse-trough. In fact, archaeologists have now found a skeleton in the church with battle wounds and a distinctive curved spine that matches historical descriptions of the lost king.

The team is careful to say that they're not sure they have found King Richard III, only that the skeleton warrants further examination, including DNA tests. Results are expected in January.

Well, it's no Key Lime Pie, but Android 4.2 is certainly a treat in its own right. The latest version of Google's mobile OS makes a number of evolutionary improvements to its already impressive repertoire -- including a new quick settings menu that can be accessed from the notification pull down and support for multiple user profiles. The multiple user support is especially handy for tablets like the new Nexus 10, which are much more likely to be shared, and now offer quick and easy user switching right from the lock screen. If you don't want to share your tablet, just what's on it, the new support for Miracast makes will allow you to wirelessly beam movies, games or anything else to a compatible display. The 10-inch tablet UI has also received a slight tweak, moving closer to the design for phones and the Nexus 7, with centered navigation buttons and the notification area up top. It might seem strange for users used to the Honeycomb-style tablet layout, but the new design is much simpler and provides a consistent experience across devices.

Google has also overhauled the photo experience and added Photo Sphere -- a 360-degree panoramic shooting mode that captures everything around you. Obviously, you'll be able to post those shots to Google+, but you'll also be able to add them to Google Maps, basically creating your own personal Street View. Interestingly, Google has also taken a page from Swype's playbook, adding "Gesture Typing" to its keyboard. There's also a new screensaver called Daydream that offers up news, photos and other content when a device is docked or idle.

Perhaps the biggest, and creepiest improvements are to Google Now, which can monitor your Gmail for relevant content such as flight numbers. Hotel and restaurant reservations are now presented as cards, as are packages enroute to your humble abode. Massive storm Sandy crashes ashore in New Jersey

NEW YORK/REHOBOTH BEACH, Delaware (Reuters) - Sandy, one of the biggest storms ever to hit the United States, roared ashore with fierce winds and heavy rain on Monday near the gambling resort of Atlantic City, New Jersey, after forcing evacuations, shutting down transportation and interrupting the presidential campaign.

High winds and flooding racked hundreds of miles (km) of Atlantic coastline while heavy snows were forecast farther inland at higher elevations as the center of the storm marched westward.

More than 2 million customers already were left without power by early evening and more than a million people were subject to evacuation orders. Many communities were swamped by flood waters.

The National Hurricane Center said Sandy came ashore as a "post-tropical cyclone," meaning it still packed hurricane-force winds but lost the characteristics of a tropical storm. It had sustained winds of 80 miles per hour, well above the threshold for hurricane intensity. Sandy previously had been characterized as a hurricane.

The storm's target area includes big population centers such as New York City, Washington, Baltimore and Philadelphia.

Trees were downed across the region, untethered pieces of scaffolding rolled down the ghostly streets of New York City, falling debris closed a major bridge in Boston and floodwater inundated side streets in the resort town of Dewey Beach, Delaware, leaving just the tops of mailboxes in view.

In Washington, President Barack Obama appealed to the tens of millions of people in the hurricane's path to follow directions given to them by authorities.

"If the public's not following instructions, that makes it more dangerous for people, and it means that we could have fatalities that could have been avoided," Obama said at the White House, adding that people should expect long power outages and idled transportation systems.

U.S. stock markets were closed for the first time since the attacks of September 11, 2001, and will remain shut on Tuesday. The federal government in Washington was closed and schools were shut up and down the East Coast.

One disaster forecasting company predicted economic losses could ultimately reach $20 billion, only half insured.

Governors up and down the East Coast declared states of emergency. Maryland's Martin O'Malley warned there was no question Sandy would kill people in its way.

Sandy made landfall just south of Atlantic City, about 120 miles southwest of Manhattan. Casinos in Atlantic City had already shut down.

PRESIDENTIAL CAMPAIGN INTERRUPTED

The storm interrupted the U.S. presidential campaign with eight days to go before the election, as Obama and Republican challenger Mitt Romney canceled events. Both men acted cautiously to avoid coming across as overtly political while millions of people are imperiled by the storm.

The early signs were that New York City was mostly weathering the storm well.

"In the olden days, you would have had lots of fatalities. We're not through this yet. ... It may be as bad of (a) storm as we've ever seen, but I would expect the damage to be relatively minor," New York City Mayor Michael Bloomberg told a Monday evening news conference.

New York City evacuated neighbors of a 90-story super luxury apartment building under construction after its crane partially collapsed in high winds, prompting fears the entire rig could crash to the ground.

Meteorologists say Sandy is a rare, hybrid "super storm" created by an Arctic jet stream wrapping itself around a tropical storm.

The combination of those two storms would have been bad enough, but meteorologists said there was a third storm at play - a system coming down from Canada that would effectively trap the hurricane-nor'easter combo and hold it in place.

While Sandy does not have the intensity of Hurricane Katrina, which devastated New Orleans in 2005, it has been gathering strength. It killed 66 people in the Caribbean last week before pounding U.S. coastal areas as it moved north.

An AccuWeather meteorologist said Sandy "is unfolding as the Northeast's Katrina."

Forecasters said Sandy could be the largest storm to hit the mainland in U.S. history.

Off North Carolina, the U.S. Coast Guard rescued 14 of the 16 crew members who abandoned the replica tall ship HMS Bounty, using helicopters to lift them from life rafts. The Coast Guard later recovered the body of an "unresponsive" 42-year-old woman while continuing to search for the 63-year-old captain of the ship, which sank in 18-foot seas.

The crew of the three-mast, 180-foot (55-meter) Bounty took to life rafts about 90 miles southeast of Hatteras, North Carolina when the vessel began to take on water about 160 miles from the storm's eye.

Last week, my wife began to have severe headaches. Soon, they became unbearable, so I took her to an urgent care center. The doctor there told us she was suffering from sinusitis and an ear infection. He sent her home. When the headaches continued, accompanied with vomiting, we went to our family doctor. He immediately admitted her to the hospital. There, tests showed she was suffering from a bilateral subdural hematoma (bleeding on the brain). We spent the next five days in the Intensive Care Unit, where? doctors drilled a hole into her skull to drain the fluids. She is now at home recovering and getting a little stronger every day.

The day after we got home from the hospital, a large package addressed to my wife was delivered. We opened it to find a shoebox, its lid secured by a massive amount of Scotch tape. The box came from our 6-year-old great-niece, Victoria, who lives in Wilson, N.C.? Taped on top was a note in a young child?s wobbly printing: ?I wont ys syx . . . To AC? which we interpreted as, ?I don?t want you sick . . . to Aunt Cathy.? We haven?t had to decipher a child?s handwriting for a while, but we?re going with this interpretation.

My wife began removing the tape. With some effort, she got the lid off, only to peer into a box that was empty except for one small piece of paper encased in plastic wrap. Opening it up, my wife found a beautiful crayoned picture of a rainbow with a bird colored in blue Magic Marker flying over it. Fluffy white clouds floated above the bird.

We could tell Victoria had colored and cut out the rainbow from a coloring book and pasted it onto a sheet of white copy paper. Next, my wife discovered another piece of paper in the same handwriting as the note on top of the box. This time, our great-niece had written, ?I hopy you gft bebtr.? If my translation is correct, she was saying, ?I hope you get better.? She signed her note, ?love Victoria,? but used a heart for the ?o? in her name.

As we stared at the empty box, Victoria?s mother, Pam, called and told us to expect a package from her little girl. She didn?t know what it contained, she said, because Victoria had taped it shut before asking her mother to send it. ?It feels like an empty box,? she told us. Pam also said her daughter kept insisting if she could only get the box to Aunt Cathy, it would make her feel better.

I don?t how long it takes a 6-year-old to write more than one note, color a rainbow and draw both clouds and a blue bird, but I?m sure it was no easy task. The volume of tape she used to seal the box also showed a great deal of time and care. What my wife opened that day, although it may have seemed like an empty box, held much more. It contained all the love of a 6-year-old child who was worried about her Aunt Cathy. And that box held more than just love. It was crammed with prayers, well-wishes and hopes for a better tomorrow.

Yes, my wife spent five days in intensive care and went through a major surgery. What did we learn? Sometimes, the best medicine doesn?t come from doctors, nurses or pharmacists. It isn?t dispensed in a bottle, an IV bag or a syringe. Sometimes, it comes in an empty box.

I like empty things. Two thousand years ago, two women ran to a tomb where the body of their Friend and Savior lay. They were discussing how they could roll away the massive stone that covered the entry. Upon their arrival, they found it already moved to one side. An angel appeared and told them the Person they were looking for wasn?t there; He had risen. And inside that empty tomb lay not a note, but a pile of used burial clothes.

Through the years, I?ve heard sermon after sermon on the empty tomb. I can agree and disagree with each one. The tomb was empty of Jesus? body. But I believe that empty tomb was also filled with the magnificent love of a Savior who gave His life to show His love and resurrected to give us hope.

The next time you receive a package that seems empty, take the time to look a little more closely. When you see through the eyes of a loving giver, you?ll see the same thing a 6-year-old saw when she sent her great-aunt . . . an empty box.

(AP) ? Ukrainians voted in an election on Sunday that was expected to maintain President Viktor Yanukovych's parliamentary majority, despite his rollback on democracy during nearly three years in power.

Yanukovych's Party of Regions appeared to be capitalizing on the three issues: the jailing of the charismatic opposition leader Yulia Tymoshenko, a former prime minister; a divided opposition camp; and Ukrainians' overall disillusionment with politics.

The West is paying close attention to the conduct of the vote in the strategic ex-Soviet state, which lies between Russia and the European Union and is responsible for transporting energy supplies to many EU countries.

A strong showing by the Party of Regions would cement Yanukovych's grip on power and likely turn Ukraine further away from the West.

Ukraine's relations with the West have soured over the jailing of Tymoshenko, which prompted the European Union to shelve a long-awaited partnership deal with Kiev. If the West turns a cold shoulder to Ukraine, Moscow is likely to court Kiev to create a greater economic and political alliance.

The pro-Western opposition groups hope to gain enough parliament seats to weaken Yanukovych's power and undo the damage they say he has done: the jailing of Tymoshenko and her top allies, the concentration of power in the hands of the president, the snubbing of the Ukrainian language in favor of Russian, the waning press freedoms, a deteriorating business climate, and growing corruption.

Dmitry Kovalenko, a 50-year-old entrepreneur in Kiev, said he voted for Tymoshenko's Fatherland party in hope of ending Yanukovych's monopoly on power.

"I am against repression," Kovalenko said after casting his ballot at a polling station in central Kiev. "It's easy to win when your opponents are in jail."

But the opposition has been weakened with the jailing of Tymoshenko, the 51-year-old heroine of the 2004 Orange Revolution which threw out Yanukovych's fraud-tainted victory in a presidential vote.

Tymoshenko's party is running neck-to-neck with another pro-Western group, the Udar (Punch) opposition party led by world boxing champion Vitali Klitschko.

Klitschko's party has gained popularity in recent months, capitalizing on voter disappointment with both Yanukovych's rule and Tymoshenko's years in power that were marked by constant bickering in the Orange camp.

"We've tasted both the orange and the blue, and life hasn't changed for the better," said Zhanna Holovko, a 43-year-old high school teacher in Kiev, referring to the campaign colors of the Orange revolution team and Yanukovych's party. "I am voting for a third force that I can trust," Holovko said after casting a ballot for Klitschko's group.

The opposition's failure to form a strong alliance has played into the hands of Yanukovych.

While Tymoshenko's and Klitschko's parties are expected to make a strong showing in elections by party lists, half of the 450 seats in the Verkhovna Rada parliament will be allocated to the winners of individual races, in which Yanukovych loyalists are expected to take the lead. Yanukovych has centered his party's campaign on bringing stability after years of infighting in the Orange camp and relative economic recovery after the global financial crisis, which hit Ukraine severely.

"Stability, stability, stability is what Ukraine needs," said Olexiy Nalivaichenko, 35, a civil servant in Kiev, who voted for Yanukovych's party. "We want to feel confident and secure about tomorrow."

Also expected to win seats in parliament is the Communist party, which will side with Yanukovych's supporters. Another party that could pass the 5 percent threshold needed for seats is the nationalist Svoboda (Freedom), a staunch government critic infamous for xenophobic and anti-Semitic statements.

The election tainted by Tymoshenko's jailing on charges of abuse of office has also been compromised by the creation of fake opposition parties, campaigns by politically unskilled celebrities, and the use of state resources and greater access to television by Yanukvoych's party.

At one polling station in Kiev, voters complained that a clone politician with the same last name as Fatherland's candidate was intended to split the opposition vote.

"This doesn't look good," said Yevhen Yefimov, 43, a Kiev computer specialist, who was nearly fooled into voting for the fake politician rather than a Tymoshenko candidate. "They are trying to trick people into making a mistake ... to steal Fatherland votes."

What will happen this next week with FamilySearch Family Tree?

It was announced by the Directors of the Mesa FamilySearch Library that they received an email notice that FamilySearch Family Tree on FamilySearch.org would be "introduced" during the week of 29 October 2012. I have been wondering what the "introduction" will consist of and watching the program carefully. Since the program has been active and not in a Beta test since February, 2012, I have been speculating about the changes that might occur to constitute an introduction.

First, in response to some severe criticism lately, let me say; I am not associated with FamilySearch other than as a volunteer with the FamilySearch Research Wiki, as a contributor to the FamilySearch TechTips and other voluntary associations. I am not an employee of FamilySearch and I do not claim any particular insider knowledge. I do watch FamilySearch carefully as an outsider. I do this for several reasons, primarily because I am a member of The Church of Jesus Christ of Latter-day Saints (LDS or Mormon) and have been using FamilySearch and its predecessors for over 30 years to do my research. Secondarily, because as a genealogist, part of my motivation for seeking out my family comes from my beliefs as a member of the Church.

If my association with the Church and/or my enthusiasm for FamilySearch and its efforts to support the genealogical community bother you, then find something else to do with your time and ignore my posts.

In addition, although there are other wonderful genealogical resources out there in the world, some free and some by subscription, I just happen to believe that FamilySearch Family Tree shows the best promise of being the solution to some of the problems found in the research in my own family lines. I fully realize that very few genealogists out there in the community have generations of previous genealogical research in their family lines such as those among my ancestors. This is both good and bad news if you are in this position. The good news is that the records are usually available, the bad news is that very, very little of the family lines have been documented or sourced. Much of the information is either incomplete or incorrect. Hitherto, I have had no way to sort out this huge tangle of information. I see FamilySearch Family Tree as the first glimmerings of a solution to sorting out what is and what is not accurately recorded about my family.

I started this process over thirty years ago and I just might live long enough to finish it. For the first time I believe I have the tools to do the job. So those are some of the reasons I keep a close watch on FamilySearch. It is mostly out of self interest.

So, what will happen next week? I doubt that even those at FamilySearch are exactly sure. But the program will continue to evolve and I will keep working on my family lines and all my other projects. And, I will likely continue to write, despite the criticism, until my fingers and mind no longer work.

AJ McCarron passed for 208 yards and two touchdowns, and the top-ranked Crimson Tide reached the end zone on its first three possessions in a muscle-flexing 38-7 victory over No. 13 Mississippi State on Saturday night.

That blazing start indicated Bama wasn't looking ahead to No. 6 LSU in a national game rematch ? at least until the second quarter.

"We felt like we had something to prove, because they felt like they could come in our house and beat us," Tide linebacker CJ Mosley said. "As a defense we did a great job of stopping the run and making them try to beat us with the pass."

I think it was important for us to get off to a fast start in this game, preparing yourself to fight a 15-round fight, knowing that you're going to have to take the fight to them in the early rounds.

"You can't necessarily win the fight in the first round, but you can certainly lose it. I think we had the right amount of energy and the right physical energy to play in the game."

The Bulldogs (7-1, 3-1) came in averaging 36.7 points but didn't score until the final minutes. They had been leading the nation in turnover margin but lost two fumbles and an interception.

McCarron completed 16 of 23 passes before sitting out the fourth quarter. He headed to the locker room briefly early in the quarter with a bruised back but returned to the sideline. Saban said he could have returned and will be fine for the LSU game.

The Tide has now won the past five meetings and this one turned into more of the same, despite considerably more hype.

"They're No. 1 for a reason ? they don't make mistakes," Mississippi State cornerback Johnthan Banks said. "I haven't played a team like that since I've been in college. I have great respect for AJ McCarron. He doesn't make mistakes."

The Bulldogs had started 7-0 for only the second time in program history. Instead of proving they were legitimate SEC contenders, this game showed they have a ways to go.

McCarron hit Kenny Bell in stride for a 57-yard touchdown to cap a drive that started at Alabama's 4. He then found tight end Michael Williams for a 9-yard score early in the second quarter.

His 18 touchdowns tie him with John Parker Wilson for second-most in school history, two behind Greg McElroy's single-season record.

T.J. Yeldon rushed for 84 yards on 10 carries, including an 11-yard touchdown. The subs tacked on two touchdowns after turnovers in the fourth quarter.

It wasn't the finish that mattered the most, but the start.

"This is a big game for us and we knew that they were going to come out really believing they could win the game," Tide center Barrett Jones said. "And that's when we knew we had to come out and play hard in the beginning. We really started fast. That's something we talked about all week."

Alabama held the SEC's leading rusher, LaDarius Perkins, to 38 yards on 15 carries after he came in with three straight 100-yard efforts. The Tide outgained Mississippi State 414-256.

Tyler Russell completed 15 of 30 passes for 169 yards but threw just his second interception of the season and took a number of hits from the nation's top defense.

"I think our guys are disappointed. They came in and expected to win the game," Mississippi State coach Dan Mullen said. "And probably nobody else out there thought we would. And I love our fans and how they believed in us. We didn't just believe, I think our guys expected us to win."

Alabama's 24-0 halftime lead held until Mississippi State had a muffed punt and another fumble in the fourth. Then Alabama's backup quarterbacks came in to convert those mistakes into touchdowns.

Phillip Ely hit Eddie Lacy for a 27-yarder and then Blake Sims led another scoring drive capped with a 3-yard touchdown run by freshman Kenyan Drake.

The Bulldogs finally scored on backup quarterback Dak Prescott's 2-yard touchdown pass to Robert Johnson with 4:39 left in the game.

Mississippi State couldn't cash in on two other scoring chances before the game really got out of hand. First, Dee Milliner blocked a 31-yard field goal attempt on the opening drive.

Then, Russell drove the Bulldogs 97 yards from their own 2-yard line before Robert Lester picked off a pass in the end zone late in the third.

"Things we've done right all year long, we couldn't do that against the No. 1 team in the country," Mississippi State linebacker Cameron Lawrence said. "These boys are the real deal.

"I feel like we played our worst game and Alabama capitalized on our mistakes. "

Mississippi State managed to slow down Alabama's offense for a stretch after getting bullied in the first 17 minutes but couldn't find many holes in the defense.

The Tide has two shutouts and has lost two more in the final minutes with the reserves on the field.

VHP to support Leh bandh

The Vishwa Hindu Parishad (VHP) Sunday announced its support to a call for a shutdown of Leh Monday. The civil society of Buddhist-majority Ladakh has called for a strike to protest the "forcible conversion of Buddhists by the Muslims".

Twenty-six Buddhists of Zanskar tehsil in Kargil district allegedly converted to Islam last month.

VHP state president Rama Kant Dubey said: "Forcible conversions of these Buddhists in Zanskar area of Kargil were done at behest of the Muslim community, against the wishes of Buddhists. There is criminal silence of the administration against the people who compelled the Buddhists to embrace Islam. It shows the connivance of the administration."

Dubey questioned why no action was taken against officials despite a protest lodged by the VHP and the Buddhists of those areas.

According to Muslim community leaders, "a few Buddhist families in Zanskar in Kargil district converted to Islam of their own free will without any force or coercion last month".

This led to communal tension in Zanskar. Both communities clashed last week resulting in damage to property and injury to protestors. The administration had to impose a curfew Oct 24.

Here's Why Apple Says Its Margins Are Going To ... - Business Insider

Apple told analysts yesterday that its forecasting a 36% gross margin for the holiday quarter.

Analysts were expecting a 43% margin for the quarter. The reason for the huge gap in margins is that Apple decided to refresh almost everything it makes in the last two months. (New iMacs, iPhones, iPads, and MacBooks.)

On the earnings call, CFO Peter Oppenheimer said, "New or re-priced versions of our products announced during this time frame represent over 80% of the total expected December quarter revenue."

These new products are going to be expensive to manufacture initially. As Apple gets better at making them, it should be able to make more money on them.

He also noted that on the iPad mini, the "gross margin is significantly below the corporate average." So, the iPad mini is dragging things down, too.

This is the most prolific product period in Apple's history. We have an unprecedented number of new product introductions over the last six weeks and this has led to record levels of demand. New or re-priced versions of our products announced during this time frame represent over 80% of the total expected December quarter revenue.

But there are costs associated with such dramatic change and demand. The iPhone 5, iPad Mini, iMac, MacBook Pro 13-inch, iPod Touch and iPod Nano have completely new form factors with great new features and we've never before introduced so many new form factors at once. All of these products have higher costs than their predecessors and therefore lower gross margins as they are at the height of the cost curve.

This has been the case with new products in the past, so nothing new. The difference this time is the sheer number of new products we are introducing in a very short period of time. Additionally, we lowered the price of the iPhone 4S and iPhone 4, delivering incredible value to our customers. We head into this holiday quarter with the strongest iPhone line-up that we have ever had with the iPhone 4 starting at three in the subsidized markets. We also added the iPad Mini to our iPad line-up. The iPad Mini has the iPad experience and we priced it aggressively at $329 delivering incredible value to our customers.

Its gross margin is significantly below the corporate average. So in summary, we expect our gross margin to decline by about 400 basis points sequentially. We expect the benefit from positive leverage on the sequentially higher revenue and a greater mix of iPhone, but we expect these benefits will be more than offset by a number of factors.

First, margins on new products are lower than their predecessors including the iPhone 5 and we have been aggressive with the iPad Mini. Second, we?ve lowered the price of the iPhone 4S and the iPhone 4. Third, we will experience transitionary costs associated with multiple new product ramps. Fourth, the high end anticipated volume of iPhone and other new products will generate significantly greater deferred revenue sequentially.

As you are aware, we differ a portion of our revenue with every device we sell and amortize it back into revenue over the life of the device. [In period] have exceptionally strong sales like the December quarter the deferred amounts are significantly higher than the revenue amortized in from past sales. And fifth the favorable items that benefited the gross margin in the September quarter are not expected to repeat in the December quarter.

We will work hard to try and get down the cost curves and improve our manufacturing and other efficiencies as we?ve successfully have done in the past. We ended this holiday season with our strongest product line-up ever and we have great choices for customers. To be in position to anticipate over $50 billion of demand for our products in a single quarter is a reflection of the incredible strength of our products and our business.

And Tim Cook added the following:

In 2 murder cases, mothers turn in their own sons

GOLDEN, Colo. (AP) ? Mindy Sigg sat sobbing on Thursday, listening to prosecutors tell a court that her 17-year-old son had confessed to the abduction and killing of 10-year-old Jessica Ridgeway.

While any mother would be devastated, there was an even more heartbreaking wrinkle for Sigg: She was the one who called police.

It was not the only high-profile case this week in which a mother made that painful choice. In New Jersey, Anita Saunders saw something on a Facebook page that led her to call police.

Her two sons, ages 15 and 17, are now charged with murdering 12-year-old Autumn Pasquale, a bike-lover who authorities said was lured to their home with the promise of new parts.

What does it feel like to turn in your child, knowing they could be sentenced to many years in prison? Surely, no one knows but those who've done it.

But a main motivation, according to one criminologist, is simply a desire to do the right thing.

"These are law-abiding people, pro-social people," said Kathleen Heide, professor of criminology at the University of South Florida. "And besides doing the right thing, the parents often want to get their children help."

What they often aren't aware of, though, are the full ramifications in terms of likely punishment.

"If these are cases of first- or second-degree murder, in most cases the kids will be charged as adults," Heide said. "This means they can be sentenced to life in prison."

In both cases, authorities are deciding whether to prosecute the suspects as adults.

Certainly not all parents are ready to turn in their kids. One high-profile case from the 1990s, in fact, resulted in strains between the United States and Israel, when a father helped his teenage son escape this country after a particularly brutal murder in Maryland. The son, Samuel Sheinbein, confessed and is now serving a 24-year sentence in Israel ? a lighter term than he likely would have gotten in the United States.

Mindy Sigg made a different decision. Reached by phone on Wednesday, she told The Associated Press: "I made the phone call, and he turned himself in. That's all I have to say." Then she broke down in tears.

Her son Austin Reed Sigg made his first court appearance Thursday in the death of Jessica and in a separate attack on a 22-year-old runner, who managed to break free, in May.

Prosecutors say he has confessed in both cases, and investigators have overwhelming DNA evidence against him. He was ordered held without bail; prosecutors are expected to formally charge him next week.

Sigg's father, Rob Sigg, issued a written statement Thursday commending his ex-wife's decision and asking for prayers and support for the Ridgeway family.

"This horrible event is a tragedy for both the families, as well as the community. I ask also for your prayers and support for Austin's mother, whose courageous act ? unimaginably painful for any parent ? has put this tragedy on the path to resolution," he said. "I am hopeful that as the legal process unfolds, the Ridgeway family may come to know peace."

Peg Claspell, who lives near the Siggs, said she was grateful to the mother for her decision and called it the "most loving, difficult thing."

"I can't imagine the pain for her, and she's in my prayers," Claspell said. "She has a long and difficult time ahead of her."

Claspell's husband, Tom, struggled when asked if he would turn in a child. "I can say yes, but I don't know if I would. It would be a very hard thing to do," he said, explaining it would depend on the severity of the crime.

In a case like this, "I probably would," he said.

In the New Jersey case, Justin Robinson, 15, and Dante Robinson, 17, have been charged with murder and other counts in the death of 12-year-old Autumn, whose body was found Monday stuffed in a recycling bin only blocks from her home in Clayton.

An autopsy found the seventh-grader suffered blunt force trauma consistent with strangulation.

The boys are due in court Friday for a hearing to determine if they will remain in custody.

What's rare about both cases, said Heide, the criminologist, is that boys of this age rarely kill girls, especially girls so young. "Usually boys this age kill other males, and in their own age cohort," she said.

Jessica disappeared three weeks ago after leaving her home in the Denver suburb of Westminster to walk to school. She never arrived. Her remains were found on Oct. 10. Sigg was taken into custody late Tuesday after police received the mother's phone call. He lived about a mile from Jessica.

Sigg wore a blue-green jail uniform and had a light goatee when he appeared in a heavily guarded courtroom in Golden.

Four of his family members were seated in the court, and they sobbed at times during the hearing.

When District Judge Ann Gail Meinster asked Sigg if a parent was present, he said "Yes" and looked toward his relatives. He then mostly sat with his head bowed.

Seven of Jessica's family members sat in the courtroom with their arms around each other. Sigg glanced in their direction just once.

Public defender Ryan Loewer had argued for setting bail for Sigg, saying he has no prior criminal history. Prosecutor Hal Sargent said Sigg had confessed and investigators had a strong case.

"There's DNA evidence, and the evidence is overwhelming," he said.

After the hearing, Jefferson County District Attorney Scott Storey said prosecutors cannot seek the death penalty for Sigg because he is a minor.

Storey said the law is unclear on whether Sigg could be sentenced to life in prison.

The U.S. Supreme Court ruled in 2005 that the death penalty was unconstitutional for minors. Colorado law allows for life sentences for juveniles convicted of serious crimes, but it would be up to a judge to determine whether that's appropriate, Storey said.

Storey declined to discuss the possibility that Sigg might enter an insanity plea.

Former high school classmates painted a picture of Sigg as an intelligent teen who often wore black and complained about school but who would stay late sometimes to work on computers. Sigg was interested in mortuary science and was taking forensics classes, said Rachel Bradley, 17, who attended Standley Lake High School with him.

Sigg enrolled in August at Arapahoe Community College, which offers the state's only accredited mortuary science program. He didn't have enough credits yet to apply to that program.

Sigg had left Standley Lake High in July after finishing the 11th grade and later earned a GED. School officials don't know why he left.

Former schoolmate Sarah Morevec said Sigg had been bullied for having a high voice.
